 US ELECTION :Texas Files Law Suit against 4 Battleground States with SCOTUS

Biggest legal news regarding the Election so far.
This programme explains it all.
Texas has basically sued the other states regarding the US Election .

In his latest post ,he has continued to say that the Surpreme court has excepted the law suit at about 7min 40.Dont know why the other was taken down.He also is saying other states have also joined the lawsuit.

Here is another video explaining the Texas Lawsuit from a law group.These guys were saying they expected news today on it so the previous video is consistant with the Supreme Court making a decision today on whether its decided to listen to the case.

Here is a report saying that the Texas Lawsuit has been added to the docket today which means according to this report that the Supreme Court will hear the case.This more than likely is why the Pennyslavania Kelly Parnell case is not being heard as it covers the same ground ,

Legal procedure note:

This is an original action, not an appeal. The SCOTUS has exclusive original jurisdiction when states file suit against one another.

Docketing the case does not mean the Court has made any determinations as to merit. Just as if a victim in a car wreck filed suit in small claims court, that case gets put on a docket. The trial court has to accept the case and it is subject to normal trial court defenses.

In this case, docketing means it has been filed. That's all.
The SCOTUS IS the trial court here. There is no appeal from it.

In this case, Texas seeks a preliminary injunction and temporary restraining order. The case's first hearing will be Texas showing that it has a clear legal right to the relief requested, that irreparable harm will occur without the relief requested AND MOST IMPORTANTLY that it is substantially likely that Texas will prevail on the merits.
It is a case where, most likely, if Texas does not get its emergency relief it will be game over. But, if it does? Not sure because I haven't read any of it, any law on it nor what relief the Court could grant and how much difference that relief would make.

But, we will know pretty soon.

I will add that Ted Cruz said he would argue the case before the Court. He has a very good record as an attorney before the Supreme Court.

Yeah thats what the videos say that SCotus is the only place for Texas to go.
I think nobody saw this one coming at all.I think SCOTUS is in a situation where if they dont hear it they are saying in effect that its ok if the law is changed without the legislatures involvement and if they do hear it they will have to make a decision.

Here is an update about the Pennyslavania case .In this one the poster says the case has not been rejected and MSM are reporting it wrongly ,surprize surprize!

Anyway two cases have got as far as the Supreme Court when alot people didnt think they had a chance and if the Texas goes the full distance it must have a good chance,

There is no significance to it being docketed. Docketing is just proof of filing. They will hear the the case as a trial court hears a small claims case in your local courthouse. They don't have a choice but to accept the case on a docket.

Now, where they WILL weigh in we will see. These states may raise defenses (some or all of these states) that the Court looks at on paper and says "yeah, that's right, case dismissed." Or, they may say, "let's set it for hearing". It will be presided over by Chief Justice Roberts and any decisions rendered after the evidentiary hearing on the TRO will be the product of the full Court's opinion.

Because of the kind of case this is (I mean because it is a TRO case) you COULD have what looks like a victory at the initial hearing turn into a defeat at trial on the merits. This happens all the time in TRO/injunction cases.

I don't know what will occur. But we should not read into anything at this moment because these procedures do not yet mean anything about the ultimate success or failure of this litigation.
